Vantagepoint AI, LLC and VantagePoint Intermarket Analysis Software (collectively “us,” “we,” “our” or the “Company”) respect your privacy and we are committed to protecting it through our compliance with this privacy policy (“Privacy Policy”). This Privacy Policy describes the types of information we may collect from you or that you may provide to us when visiting or using our website www.vantagepointsoftware.com, mobile or desktop applications, and software (collectively, the “Site”). This Privacy Policy is only applicable to information we collect on the Site and in email or other electronic messages between you and the Company. This Privacy Policy does not apply to information collected by us offline or through any other means (except for cell phone numbers obtained from prospective customers texting into the Company in response to a radio advertisement, as the radio advertisement does direct listeners to this privacy policy giving the Company consent to message and call) or any other websites that you may be able to access or link to from the Site, each of which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy.
Consent for Use of Site
By accessing or using the Site, you agree to this Privacy Policy and our Site Disclaimer and Terms, which is incorporated by reference into this Privacy Policy. If you do not agree with our policies and practices, you may choose not to use our Site. Your use of the Site, and any dispute over privacy, is subject to this Privacy Policy and our Disclaimer and Terms, including its applicable limitations on damages and the resolution of disputes by arbitration. Our goal is to provide world class customer support by delivering the most current information to our customers and those interested in VantagePoint software. By providing your phone number, including by filling out an online form (on our website or one of our partner’s websites) or by calling or texting in, you agree to Terms of Service and this Privacy Policy (which affect your rights) and consent to email, phone, and text message communications for marketing purposes from Vantagepoint AI, LLC, including via automated technology, artificial or prerecorded messages, or using artificial intelligence. Consent is not required for any purchase. Message and Data rates may apply. You can withdraw consent at any time by emailing us at optout@vantagepointsoftware.com or by replying STOP to any text message. We will not sell or share your personal contact information with any outside companies.
Types of Information Collected
Traffic Data
We may automatically track and collect several types of information from and about users of the Site, including the following:

They permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity). We may request that you provide us with certain information that is about you but individually does not identify you or that personally identifies you (collectively, “Personal Information”). Other than as described herein, we do not collect any Personal Information about you unless you voluntarily provide it to us.
Personal Information may include information that you provide by filling in forms on the Site, posts to our social media outlets, records and copies of correspondence if you contact us, responses to surveys, details of transactions and fulfillment of orders conducted through the Site, and other information we collect directly from you. Data Security
We maintain comprehensive security measures to protect your Personal Information from unauthorized access, use, alteration, and disclosure. Our security program includes:
- Technical safeguards including encryption of data during transmission using secure socket layer technology (SSL), firewall-protected servers, intrusion detection systems, and continuous security monitoring

We require the same high standards from our service providers through contractual agreements that mandate appropriate security measures for any customer data they process on our behalf.
Account Security Responsibilities
You play an important role in protecting your account. Keep your password confidential and do not share it with anyone. If you use public areas of the Site such as message boards or chat features, be aware that information you post there may be visible to other users.
Data Breach Response
In the event of a security incident that affects your Personal Information, we will investigate promptly and notify you in accordance with applicable state and federal law requirements.

Service providers who receive your information are contractually obligated to use it only for the specific services they provide to us and are prohibited from using your contact information for their own marketing purposes or sharing it with other parties.
Mobile Information and Text Messaging
No mobile information will be shared with any outside parties for marketing or promotional purposes. All text messaging originator opt-in data and consent will be used exclusively by Vantagepoint AI, LLC and will not be shared with any outside organizations. Information sharing with subcontractors is limited strictly to support services (such as customer service platform providers) and only to the extent necessary for them to perform those specific services for us.
You may opt out of text messages at any time by replying STOP to any message or by emailing optout@vantagepointsoftware.com.
Children Under 16
This Site is not intended for users under the age of 16. We do not knowingly collect any personal information from children under 16. If we become aware that a person submitting information is under 16, we will attempt to delete the information as soon as possible. By using this Site, you hereby represent that you are at least 16. Your Choices and Rights
In certain jurisdictions, you may also have the following rights regarding your Personal Information:
Right to Request Access to Your Personal Information. You may request access to your Personal Information by contacting us at the address described below. If required by law, upon request, we will grant you reasonable access to the Personal Information that we have about you.
Right to Request Deletion of Your Personal Information. Right to Data Portability. In certain circumstances you have the right to request that we provide the Personal Information which you provided to us in a structured, commonly used, and machine-readable format; and you have the right to transmit such Personal Information to another entity.
Right of Non-Discrimination/Retaliation. We do not discriminate against individuals who exercise any of their rights described in this Privacy Policy, nor do we retaliate against individuals who exercise these rights. However, we may require use of your Personal Information to provide access to the services. Therefore, when you exercise your deletion right, in particular, you may lose access to certain aspects of the services that require your Personal Information.
Right to Opt Out of Marketing Communications. You have the right to opt out of receiving marketing emails, phone calls, and text messages from us at any time. You may opt out by:

To exercise these rights, your request must: (i) provide sufficient information that allows us to reasonably verify that you are the person about whom we collected Personal Information or an authorized representative of that person; and (ii) describe the request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We may need additional information to confirm your identity or your authorized agent’s identity (such as your name, email address and date of birth) or to obtain proof that you have given your authorized agent permission to act on your behalf. If our verification process is successful, we will respond to your request within the time and in the manner required by applicable law. If we cannot validate the identity of you and your authorized agent or obtain proof that you have given your authorized agent permission to act on your behalf, we will attempt to contact you to inform you.
If you designate an authorized agent to submit requests to exercise certain privacy rights on your behalf, we will require verification that you provided the authorized agent permission to make a request on your behalf. You must provide us with a copy of the signed permission you have given to the authorized agent to submit the request on your behalf and verify your own identity directly with us. If you are an authorized agent submitting a request on behalf of an individual, you must attach a copy of a completed Authorized Agent Designation Form (or equivalent form) indicating that you have authorization to act on the individual’s behalf.
California Privacy Rights
If you are a resident of the State of California, under the California “Shine the Light” law, you have the right to request from companies conducting business in California certain information regarding our disclosure of Personal Information for direct marketing purposes.
