Vantagepoint AI, LLC and VantagePoint Intermarket Analysis Software (collectively “us,” “we,” “our” or the “Company”) respect your privacy and we are committed to protecting it through our compliance with this privacy policy (“Privacy Policy”). This Privacy Policy describes the types of information we may collect from you or that you may provide to us when visiting or using our website www.vantagepointsoftware.com, mobile or desktop applications, and software (collectively, the “Site”). This Privacy Policy is only applicable to information we collect on the Site and in e-mail or other electronic messages between you and the Company. This Privacy Policy does not apply to information collected by us offline or through any other means (except for cell phone numbers obtaining from prospective customers texting into the Company in response to a radio advertisement as the radio advertisement does direct listeners to this privacy policy giving the Company consent to message and call) or any third-party websites that you may be able to access or link to from the Site, each of which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy.

Our goal is to provide world class customer support by delivering the most current information to our customers and those interested in VantagePoint software. By providing your phone number, including by filling out an online form (on our website or one of our partner’s websites) or by calling or texting in, you agree to Terms of Service and this Privacy Policy (which affect your rights) and consent to email, phone, and/or text message communications for marketing purposes from or on behalf of Vantagepoint AI, LLC, including via automated technology, artificial or prerecorded messages, or using artificial intelligence. Consent is not required for any purchase. Message and Data rates may apply. You can withdraw consent at any time by emailing us at optout@vantagepointsoftware.com. We will not sell your personal information to companies other than the few listed in our Privacy Policy.

TYPES OF INFORMATION COLLECTED

 TRAFFIC DATA

We may automatically track and collect several types of information from and about users of the Site, including the following: (1) your IP address; (2) your internet service provider; (3) your browser type and version, (4) your operating system; (5) your location; and (6) other information about your equipment, browsing actions and patterns (collectively “Traffic Data”).

Traffic Data is anonymous; however, we may maintain it or associate it with personal information we collect in other ways or receive from third parties. This information is helpful for marketing purposes or for improving your experience on the Site.

The technologies we may use to collect this Traffic Data include:

We may request that you provide us with certain information that is about you but individually does not identify you or that personally identifies you (collectively, “Personal Information”). Other than as described herein, we do not collect any Personal Information about you unless you voluntarily provide it to us.

Personal Information may include information that you provide by filling in forms on the Site, posts to our social media outlets, records and copies of correspondence if you contact us, responses to surveys, details of transactions and fulfillment of orders conducted through the Site, and other information we identify from our outside third-party partners. If we have sent you an e-mail, you may “unsubscribe” or opt-out of our emails at any time. Instructions for opting out are clearly communicated in each and every email message or you may contact us directly. The above excludes text messaging originator opt-in data and consent; this information will not be shared with any unaffiliated third parties.

CHILDREN UNDER 16

This Site is not intended for users under the age of 16. We do not knowingly collect any personal information from children under 16. If we become aware that a person submitting information is under 16, we will attempt to delete the information as soon as possible. By using this Site, you hereby represent that you are at least 16.  YOUR CHOICES and rights

In certain jurisdictions, you may also have the following rights regarding your Personal Information:

  • Right to Request Access to Your Personal Information. You may request access to your Personal Information by contacting us at the address described below. If required by law, upon request, we will grant you reasonable access to the Personal Information that we have about you.   • Right to Data Portability. In certain circumstances you have the right to request that we provide the Personal Information which you provided to us in a structured, commonly used, and machine-readable format; and you have the right to transmit such Personal Information to another entity.
  • Right of Non-Discrimination/Retaliation. We do not discriminate against individuals who exercise any of their rights described in this Privacy Policy, nor do we retaliate against individuals who exercise these rights. However, we may require use of your Personal Information to provide access to the services. Therefore, when you exercise your deletion right, in particular, you may lose access to certain aspects of the services that require your Personal Information.
  • Right to Opt Out of Our Use of Your Sensitive Personal Information (in certain instances and if permissible under applicable law). You have the right to request the restriction of processing of your Sensitive Personal Information. However, we do not use or disclose Sensitive Personal Information for purposes other than those expressed in this Privacy Policy or as otherwise permitted by applicable law, and these uses cannot be limited under applicable law.

 Many of the above rights are subject to exceptions and limitations. For example, you may be located in a jurisdiction that does not give you the right to make these requests. In such a case, your request may not be fulfilled. We may need additional information to confirm your identity or your authorized agent’s identity (such as your name, email address and date of birth) or to obtain proof that you have given your authorized agent permission to act on your behalf. If our verification process is successful, we will respond to your request within the time and in the manner required by applicable law. If we cannot validate the identity of you and/or your authorized agent or obtain proof that you have given your authorized agent permission to act on your behalf, we will attempt to contact you to inform you.

If you designate an authorized agent to submit requests to exercise certain privacy rights on your behalf, we will require verification that you provided the authorized agent permission to make a request on your behalf. You must provide us with a copy of the signed permission you have given to the authorized agent to submit the request on your behalf and verify your own identity directly with us. If you are an authorized agent submitting a request on behalf of an individual, you must attach a copy of a completed Authorized Agent Designation Form (or equivalent form) indicating that you have authorization to act on the individual’s behalf.

CALIFORNIA PRIVACY RIGHTS

If you are a resident of the State of California, under the California “Shine the Light” law, you have the right to request from companies conducting business in California certain information regarding our disclosure of Personal Information to third parties for direct marketing purposes. We reserve the right, at any time and without notice, to add to, change, update, or modify this Privacy Policy, simply by posting such change, update, or modification on the Site and without any other notice to you.
